Terms of Service

Last updated: May 11, 2026. These terms govern your use of Foyer. By creating an account or embedding the Foyer widget on your site, you agree to them.

1. The agreement

"Foyer," "we," "our," and "us" refer to the operator of tryfoyer.ai and the Foyer voice sales agent platform (the "Service"). "You" means the person or entity that creates an account or installs the widget.

These Terms of Service ("Terms") form a binding agreement between you and Foyer. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Your account

You must be at least 16 years old to use Foyer. You're responsible for the accuracy of the information you give us, for keeping your password secure, and for everything that happens under your account. Notify us promptly at hello@tryfoyer.ai if you suspect unauthorized access.

3. What Foyer does

Foyer provides a hosted voice agent that embeds on your website via a script tag. The agent uses content from your site (and any extra context you provide) to answer visitor questions in voice, capture leads, and navigate your pages. We crawl your site to build the agent's knowledge base and re-crawl on request.

You agree not to use Foyer to:

We can suspend or terminate accounts that violate this section. Where a violation is severe — for example, illegal content — we may act without notice.

5. Your content

"Your Content" means anything you upload, paste, or otherwise provide to Foyer: your website content we crawl, custom instructions, brand assets, recordings, transcripts, and lead data captured by your agent. You keep ownership of Your Content.

You grant Foyer a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create derived embeddings of Your Content only for the purpose of operating the Service for you. We don't use Your Content to train our general models. You're responsible for ensuring you have the right to share Your Content with us.

6. Plans, billing, and refunds

Paid plans are billed in advance, monthly or annually, through Stripe. Prices are listed at tryfoyer.ai/#pricing. We may change pricing for future billing cycles with at least 14 days' notice; your current cycle is unaffected.

Yearly plans

Yearly plans are billed as a single annual charge. They renew automatically each year unless you cancel before the renewal date. We do not pro-rate refunds for unused portions of an annual term, except where required by law.

Refunds

If you cancel a monthly plan, you keep access through the end of the current paid month and won't be charged again. We can review refund requests case-by-case for the most recent charge within 30 days. Refunds beyond 30 days are generally not granted.

Failed payments

If a charge fails, your agent may be paused until payment succeeds. Repeated failures may result in account termination.

7. Voice minutes and overage

Each plan includes a monthly allotment of voice minutes. A "minute" is one minute of conversation between your agent and a visitor (rounded to the second, billed in whole minutes). Unused minutes do not roll over.

If you approach your monthly allotment, we'll notify you in the dashboard. You can buy additional minute packs at any time. The Free tier's 100 minutes is a lifetime trial and does not reset monthly.

8. Affiliate program

If you sign up as an affiliate at tryfoyer.ai/affiliate, the following terms apply in addition to these Terms.

9. Intellectual property

The Foyer Service, including the widget code, dashboard, documentation, branding, and underlying software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You may not copy, modify, reverse-engineer, sublicense, or redistribute the Foyer codebase, except where the law expressly permits it.

Feedback

If you send us suggestions, ideas, or feedback, we can use them without restriction or compensation.

10. Privacy and data

How we collect and handle personal data is described in our Privacy Policy. By using Foyer you agree to that policy. You're responsible for telling your own site visitors that a voice agent is in use, and for any consent your jurisdiction requires (for example, GDPR or CCPA notices).

11. Third-party services

Foyer relies on third parties to run, including (but not limited to) Stripe (payments), Rewardful (affiliates), and the speech and language model providers our agents call. Their terms and privacy policies also apply to the parts of the Service they power. We're not responsible for outages or changes in third-party services we don't control.

12. Availability and changes to the Service

We work to keep Foyer available, but we don't promise specific uptime unless we sign a separate written SLA with you. We may add, change, or remove features; we'll try to avoid changes that materially reduce paid functionality without notice.

13. Warranties and disclaimer

Foyer is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that agent answers will always be accurate. You're responsible for reviewing the agent's behavior on your site.

14. Limitation of liability

To the maximum extent permitted by law, Foyer (and its founders, employees, and contractors) is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service is capped at the greater of (a) the amount you paid Foyer in the 12 months immediately before the event giving rise to the claim, or (b) one hundred US dollars (US$100). Some jurisdictions don't allow this kind of limitation, in which case it applies to the maximum extent permitted.

15. Indemnification

You agree to defend, indemnify, and hold harmless Foyer and its team from any claim, demand, loss, damage, or expense (including reasonable legal fees) arising from (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

16. Termination

You can cancel your subscription at any time from the dashboard. Cancellation stops future renewals; you keep access until the end of the current paid period. We can suspend or terminate your access if you breach these Terms or for any other reason we deem reasonable, including the discontinuation of the Service.

On termination, your right to use the Service ends. We may delete Your Content after a reasonable retention window. Sections of these Terms that by their nature should survive termination (for example, IP, liability, indemnity, governing law) survive.

17. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in Delaware, and you consent to personal jurisdiction there. If you are a consumer in a jurisdiction with mandatory consumer protection laws, those laws still apply.

18. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date at the top and, where appropriate, notify you by email or in-app. Continued use of the Service after a change means you accept the updated Terms.
